1. Acceptance of Terms
By accessing the website lumberneworleans.com (the "Site"), purchasing products from Lumber New Orleans ("we," "us," or "our"), or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services. We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the Site or services after changes are posted constitutes acceptance of the modified Terms.
2. Products and Services
Lumber New Orleans sells reclaimed, salvaged, and used lumber products. We also provide services including lumber purchasing, recycling, processing, custom fabrication, and transportation. All products and services are subject to the following conditions:
- Product Descriptions: We make every effort to accurately describe our products, including species, dimensions, grade, and condition. However, reclaimed lumber is a natural product with inherent variation. Actual products may differ slightly from descriptions and photographs. Minor variations in color, grain pattern, dimensions, and surface character are expected and are not grounds for return or refund.
- Dimensions: Dimensions listed for reclaimed lumber represent approximate measurements. Reclaimed wood may not conform to modern nominal sizing standards. Actual dimensions may vary by up to 1/4 inch in thickness and width, and lengths may vary by up to 2 inches. Buyers requiring exact dimensions should specify tolerance requirements at the time of order.
- Availability: All products are subject to availability. Reclaimed lumber is sourced from demolition and salvage operations, and specific species, dimensions, and grades may not always be in stock. We will notify you promptly if an ordered item is unavailable and offer alternatives or a full refund.
- Pricing: Prices are quoted per board foot, per linear foot, per piece, or per project as specified. Quoted prices are valid for 30 days unless otherwise stated. We reserve the right to adjust pricing without notice for new orders. Accepted orders with confirmed payment are price-locked.
3. Orders and Payment
- Order Acceptance: Submission of an order does not constitute acceptance. All orders are subject to our confirmation. We reserve the right to refuse or cancel any order at our discretion, including orders placed in error, orders with incorrect pricing, or orders we cannot fulfill.
- Payment Terms: Walk-in customers may pay at the time of purchase by cash, check, or credit card. For custom orders and large projects, we require a 50% deposit at the time of order, with the balance due upon completion or prior to delivery. Net 30 terms may be available for established commercial accounts with approved credit.
- Sales Tax: Louisiana state and local sales tax will be applied to all taxable transactions unless the buyer provides a valid resale certificate or tax exemption documentation prior to purchase.
4. Shipping and Delivery
- Delivery Area: We offer local delivery throughout the Greater New Orleans area and regional delivery across the Gulf South. Nationwide shipping is available via common carriers. Delivery fees are calculated based on distance, weight, and accessibility and will be quoted separately.
- Delivery Times: Estimated delivery dates are provided in good faith but are not guaranteed. Delays may occur due to weather, road conditions, vehicle availability, or other factors beyond our control. We will communicate any significant delays promptly.
- Receiving and Inspection: The buyer is responsible for inspecting all deliveries upon receipt. Any damage, shortage, or discrepancy must be noted on the delivery receipt and reported to us within 48 hours of delivery. Claims made after 48 hours may not be honored.
- Unloading: Unless otherwise arranged, the buyer is responsible for unloading delivered materials. Our drivers are not required to unload or carry materials beyond the delivery vehicle. Forklift or crane services for heavy timbers must be arranged and paid for separately.
5. Returns and Refunds
- Return Policy: Due to the unique nature of reclaimed lumber, all sales are generally final. We accept returns only for products that are materially different from their description or have undisclosed structural defects that render them unsuitable for the specified use. Returns must be requested within 7 days of delivery or pickup.
- Return Conditions: Returned lumber must be in the same condition as received. Wood that has been cut, planed, sanded, finished, installed, or otherwise altered cannot be returned. The buyer is responsible for return shipping costs unless the return is due to our error.
- Custom Orders: Custom-milled, custom-fabricated, or specially sourced items are non-returnable and non-refundable. This includes any lumber that has been planed, ripped, cut to length, or otherwise processed to the buyer's specifications.
- Refund Processing: Approved refunds will be processed within 10 business days using the original payment method. A restocking fee of up to 15% may apply to returned items that are not due to our error.
6. Warranties and Disclaimers
- Product Warranty: We warrant that all lumber sold is accurately described regarding species, approximate dimensions, and grade at the time of sale. This warranty does not cover natural wood characteristics including checking, splitting, warping, color change, or movement that may occur after purchase due to environmental conditions.
- Reclaimed Wood Disclaimer: Reclaimed lumber is sold "as-is" with respect to cosmetic characteristics. Nail holes, surface marks, patina, weathering, saw marks, and other signs of prior use are inherent to reclaimed wood and are not defects. Buyers acknowledge that reclaimed lumber will contain these characteristics.
- Fitness for Purpose: While we provide guidance on species selection, grading, and appropriate applications, the buyer is ultimately responsible for determining that purchased materials are suitable for their intended use. We recommend consulting a structural engineer for load-bearing applications and a licensed contractor for building code compliance.
- No Implied Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS EXPRESSLY STATED IN THESE TERMS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMBER NEW ORLEANS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO THE USE OF OUR PRODUCTS OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A PURCHASE SHALL NOT EXCEED THE PRICE PAID FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
8. Buyer Responsibilities
- The buyer is responsible for verifying that purchased materials comply with all applicable building codes, zoning regulations, and permit requirements for their project and jurisdiction.
- The buyer is responsible for proper storage, handling, and acclimation of lumber after delivery. We are not liable for damage caused by improper storage, including exposure to moisture, direct sunlight, or extreme temperatures.
- The buyer is responsible for checking all reclaimed lumber with a metal detector before milling, planing, or sawing. While we de-nail and inspect all boards, hidden metal may remain.
- The buyer acknowledges that reclaimed wood may have been exposed to substances common in historic construction, including lead paint and other materials. The buyer is responsible for testing and appropriate handling.
9. Website Use
The content on our Site, including text, images, graphics, and logos, is owned by Lumber New Orleans and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission. You agree to use our Site only for lawful purposes and not to engage in any activity that could damage, disable, or impair the Site.
10. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our products and services shall be resolved in the courts of Orleans Parish, Louisiana. Both parties agree to submit to the personal jurisdiction of these courts. Before initiating any legal proceeding, both parties agree to attempt to resolve the dispute through good-faith negotiation for a period of not less than 30 days.
